I have developed a product and will soon be marketing it. I have already filed the application to register the name as a trademark for the company. However, the name is registered as a domain name that is not currently and has not been used by the current owner since it was acquired 9 years ago. What protection does he have and what rights do i have to take the product to market?

November 23rd, 2009I am appling for social services. During the summer, before the application process, I rented web space and a domain name, which i am going to use as a portfolio for school work (i am taking web design). The dept of Social Services has implied that i have a business under the same name as the domain. I have not made any money from this website or alleged business nor have a done a DBA. Can they prove I have a business? The site is not used for commercial work.
